Gift CertificatesThese Rules govern the conditions for the purchase and use of TTSWTRS gift certificates (hereinafter referred to as "Rules"). TTSWTRS, as understood in these rules, refers to a duly registered business entity that uses the TTSWTRS® trademark under licensing agreements with the rights holder and sells goods under the TTSWTRS® trademark. TTSWTRS is the seller of the Gift Certificate.1.
Gift Certificate TTSWTRS (hereinafter referred to as the "Gift Certificate") is:
1) A physical TTSWTRS gift certificate is a gift certificate purchased at a TTSWTRS offline store, represented as a card with a unique number and a paper insert containing information about the certificate's validity period, its face value, and the unique code of the Gift Certificate. This certificate entitles the holder to receive clothing and items from the TTSWTRS brand at offline and online TTSWTRS stores in the country where the seller store is registered, for an amount equal to the Gift Certificate's face value.
2) A virtual TTSWTRS gift certificate is a gift certificate purchased in the TTSWTRS online store at the link [https://ua.ttswtrs.com/products/gift-card](https://ua.ttswtrs.com/products/gift-card). It is represented electronically with a unique code, face value, and validity period. It entitles the holder to receive clothing and items from the TTSWTRS brand at offline or online TTSWTRS stores in the country where the seller store is registered, for an amount equal to the Gift Certificate's face value, by providing the unique code during the order process.
1.1. The purchase of a Gift Certificate refers to the payment of funds equal to the Gift Certificate's face value, serving as a prepayment for the goods to be transferred to the Gift Certificate holder in the future.
1.2. The country of purchase refers to the country where the seller of the Gift Certificate is registered.
1.3. An offline TTSWTRS store refers to: 1) "TTSWTRS Store Kyiv" - Ukraine, Kyiv, Antonovycha St., 17a. 2) "TTSWTRS Store Odesa" - Ukraine, Odesa, Rishelievska St., 5.
1.4. An online TTSWTRS store refers to the TTSWTRS website at [https://ua.ttswtrs.com/](https://ua.ttswtrs.com/).
1.5. The owner of the Gift Certificate is the respective TTSWTRS store. The holder/user of the certificate is the consumer/presenter.
2. The Gift Certificate is not a payment document or a security.
3. The Gift Certificate can be purchased with cash or through cashless payment.
4. The face value of the Gift Certificate is specified on the insert accompanying the Gift Certificate, in hryvnias, and corresponds to its worth. Gift Certificates are available for purchase at the cash registers of all TTSWTRS stores for cash or cashless payment, as well as in the online TTSWTRS store at the link [https://ua.ttswtrs.com/products/gift-card](https://ua.ttswtrs.com/products/gift-card).
5. Upon purchasing a Gift Certificate, a cash (fiscal) receipt for the amount paid is issued along with the Gift Certificate itself.
7. The validity period of the Gift Certificate starts from the date of purchase until the date specified in the insert accompanying the Gift Certificate, which is an integral part of it.
8. If the right to receive goods within the Gift Certificate's face value is not exercised during its validity period, the obligations of the TTSWTRS store where the Gift Certificate was purchased cease, and the amount paid for the Gift Certificate remains with the TTSWTRS store, non-refundable. The holder loses the right to use the Gift Certificate according to these Rules from 00:00 hours on the day following the last day of the Gift Certificate's validity.
9. The Gift Certificate can only be used once in a transaction with a single fiscal receipt. To exercise the right to receive goods within the Gift Certificate's face value, the holder must present the Gift Certificate to the cashier or activate its unique code in the shopping cart during an online purchase.10. The Gift Certificate is a bearer document: it can be used by the person who purchased it or any other person who presents the Gift Certificate at the respective TTSWTRS store or activates its unique code online.
12. The value of the goods must equal or exceed the Gift Certificate's face value. If the goods cost more than the face value, the holder must pay the difference in cash or cashless form. If the total is less than the face value, the unused balance is not refunded or retained. The Gift Certificate can only be used once, and any unused amount cannot be carried over to other purchases.
13. Exchanges and returns of goods purchased using the Gift Certificate are conducted in accordance with current consumer protection laws in the country of purchase.
14. The Gift Certificate is non-returnable and non-exchangeable for cash, except for the consumer's legal right to refuse the purchased goods as defined in paragraph 14.1 of these Rules.
14.1. The purchaser of the gift certificate has the right to return the Gift Certificate in accordance with current consumer protection laws in the country of purchase, exercising the legal right to refuse the goods within 14 calendar days, similar to other goods. To exercise this right, the purchaser must present proof of purchase (cash (fiscal) receipt) to the manager of the offline or online TTSWTRS store and return the physical Gift Certificate with its complete packaging, including the insert, which must remain undamaged. The return of a physical Gift Certificate is only possible at the TTSWTRS store in the country of purchase. Refunds for the Gift Certificate in the event of exercising the consumer's legal right to refuse will be processed in the same manner as the purchase was made—cash for cash purchases, cashless for cashless purchases. In other cases, the Gift Certificate is non-returnable and non-exchangeable for cash.
15. The Gift Certificate is a bearer document. In the event of loss, the Gift Certificate and its accompanying insert are not subject to recovery.
16. The administration of TTSWTRS stores reserves the right to refuse to accept the Gift Certificate in case of: - Doubts about its validity or any damage to the Gift Certificate, which must be reported to the holder immediately. - Presentation of the Gift Certificate in a TTSWTRS store in a country different from the country of purchase. In this case, the holder has the right to present the Gift Certificate in the TTSWTRS store in the country of purchase.
17. The purchase of the Gift Certificate confirms: - Payment of the Gift Certificate's value as indicated in the insert that is an integral part of the certificate. - Familiarization with and agreement of the purchaser/consumer/holder of the Gift Certificate with these Rules.
18. The holder of the Gift Certificate agrees to receive goods using the Gift Certificate at any TTSWTRS store in the country of purchase, including through online orders, thus consenting to the transfer of the seller's obligations to another entity (individual entrepreneur or legal entity).
19. These Rules may be amended unilaterally by TTSWTRS by updating them on the TTSWTRS website at [https://ua.ttswtrs.com/pages/how-to-use-giftcard](https://ua.ttswtrs.com/pages/how-to-use-giftcard), without prior notice to the holders of the Gift Certificates.20. The purchase and/or use of the Gift Certificate signifies the holder's acknowledgment and agreement with these Rules.
